These terms govern your use of evapatch.com and any purchase you make with us. Please read them carefully — they contain important information about your rights.
About These Terms
These Terms of Service (“Terms”) form a legally binding agreement between you and EvaPatch (“we”, “us”), located at 15 Pablo Street, LK, Germany. By placing an order or using our website, you agree to these Terms.
These Terms are governed by German law, in particular the Bürgerliches Gesetzbuch (BGB). If you are a consumer in the EU, you also benefit from the mandatory consumer protection laws of your country of residence.
Ordering
How a contract is formed
Placing an order on our site constitutes an offer to purchase. A binding contract is formed only when we send you an order confirmation email. We reserve the right to decline any order, for example due to stock unavailability, pricing errors, or suspected fraud.
Order accuracy
You are responsible for providing accurate shipping information. We cannot be held liable for non-delivery caused by incorrect addresses. If a parcel is returned to us due to an incorrect address, you will bear the cost of re-dispatch.
Stock
All products are handmade and available in limited quantities. We process stock changes in real time, but in the rare case an item becomes unavailable after your order is placed, we will notify you immediately and issue a full refund.
Pricing & Payment
- All prices are displayed in your selected currency and include applicable VAT where required by law.
- We accept payment via Stripe (card, Apple Pay, Google Pay) and PayPal.
- Payment is collected at the time of order. We do not store payment card details — these are handled exclusively by Stripe and PayPal.
- In the event of a pricing error, we will contact you before processing your order. You may choose to proceed at the correct price or cancel for a full refund.
- Currency conversion for non-EUR currencies is indicative. Your payment processor may apply its own exchange rate.
Shipping
- We dispatch orders within 1–3 business days of payment confirmation.
- We ship only to the countries listed at checkout. We do not ship to destinations not listed.
- Estimated delivery times are provided by the carrier and are not guaranteed. We are not liable for carrier delays.
- Risk of loss passes to you upon handover to the carrier.
- Customs duties and import taxes (where applicable) are the buyer's responsibility.
- Once an order has been dispatched, we cannot modify the shipping address.
Products
Handmade nature
All EvaPatch products are handmade. Minor variations in stitching, colour saturation, or size within ±5mm of the listed dimensions are inherent to the handcrafted process and do not constitute defects.
Colours
Product images are accurate representations, but screen calibration varies between devices. We cannot guarantee exact colour matching between your screen and the physical product.
Care instructions
- Iron-on patches: follow the application instructions included with your order.
- Sew-on patches: we recommend hand washing the garment after application.
- Do not machine wash patches at temperatures above 30°C.
Intellectual Property
All designs, images, brand names, logos, and content on evapatch.com are the exclusive property of EvaPatch or its licensors and are protected by copyright and trademark law.
- You may not reproduce, copy, distribute, or create derivative works from our designs without prior written consent.
- Purchasing a patch grants you a personal, non-commercial licence to use the physical item only.
- Commercial reproduction or resale of our designs is strictly prohibited.
- If you believe any content on our site infringes your intellectual property, contact us at contact@evapatch.com.
Liability
To the maximum extent permitted by applicable law (including § 309 BGB for consumer contracts):
- We are not liable for indirect, consequential, or incidental damages arising from use of our site or products.
- Our total liability for any claim is limited to the amount you paid for the relevant order.
- We do not limit liability for death or personal injury caused by our negligence, fraudulent misrepresentation, or any liability that cannot be excluded by law.
- We make no warranty that our website will be uninterrupted, error-free, or free of viruses.
Governing Law & Disputes
These Terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts of Germany, unless mandatory consumer protection laws in your country of residence provide otherwise.
EU Online Dispute Resolution
As required by EU Regulation 524/2013, we inform you of the European Commission's Online Dispute Resolution (ODR) platform, which can be used to resolve disputes out of court:
We are not obliged to participate in alternative dispute resolution proceedings before a consumer arbitration board and do not voluntarily do so.
Changes to These Terms
We may update these Terms from time to time. The date at the top of this page reflects when they were last revised. Continued use of our site after changes are posted constitutes your acceptance of the updated Terms.
For material changes, we will notify registered customers by email at least 14 days before the new Terms take effect.
